The Architectural Control Committee (ACC) approves or declines changes to your home. The ACC is in place to help the neighborhood maintain or increase the values of our homes, while also guiding and directing the enhancement and enrichment of our community.

Such changes that require the submission of an ACC Form A might include:

  • putting up a fence;
  • changing paint color; and
  • putting an awning on your home.

Note: Painting your home the same color as the original paint is not a change, and does not require approval.

In the recent past, many homeowners have made changes without getting approval from the ACC. Making changes without the approval of the submission of an ACC Form A is not allowed. Those homeowners who make changes without approval risk being fined by the Brushy Creek Homeowner’s Association, and put themselves at risk of having to redo the work in accordance with the Brushy Creek Community Covenants.

WHAT ARE BRUSHY CREEK COMMUNITY COVENANTS?

Brushy Creek has protective Community Covenants that were filed at the County Courthouse when the neighborhood was started several years ago. The covenants are legal restrictions effectively attached to your deeds. Residents and homeowners are requested and bound to follow these covenants and maintain certain standards in the Homeowner Association Community.

COMMON ITEMS THAT REQUIRE THE REGULAR ATTENTION OF HOMEOWNERS & THE ACC INCLUDE:

  • Please Keep Your Gas Lanterns Lit
    The reason these lanterns are so important is that this is Brushy Creek's only light source and security safeguard at night.
  • Replacement Mantels are available through Gas Products Company

  • Mantels can also be purchased from ACC member Jennifer Kudick.

  • Mail Box Compliance & Maintenance
    The Brushy Creek Board of Directors ACC Committee requires that all Brushy Creek Homeowners install and utilize a specific 'type' of mail box if your current one needs to be replaced.

    • ALL SUPPLIES ARE AVAILABLE AT THE HOME DEPOT.

    NOTE: These are the only acceptable replacements as decided by your Brushy Creek Board of Directors and ACC Committee. Residents risk being fined for non-compliance or the BC Board of Directors may exercise their Right of Abatement.

Common Items of Concern To The Brushy Creek ACC

In case some of our Brushy Creek resident may be unaware of certain covenants and architectural control guidelines we have in place, below is a very brief overview of some of the more common ones. You can obtain a detailed packet from our management company, Heritage Property Management Services, Inc.

  • Satellite Dishes must not exceed 39 inches (1 meter) in diameter. Cables must be neatly attached to the house and painted to match siding or trim as applicable.
  • Each owner is responsible for keeping his/her property in good order and repair. This includes mowing, weeding, pruning, fertilizing and any other task required to maintain a well-manicured appearance.
  • Each homeowner is responsible for the removal of debris, clippings, weeds, etc. from the property line to the center of the street. This includes curbs, sidewalks, and gutters.
  • No items of any type may be stored in the front of the house. Any items stored in the side yard or back yard must be kept neat and screened from view by shrubbery or fencing.
  • Garbage containers may not be stored in the front yard. Garbage containers must be kept in your garage or back yard out of view from the street.
  • Garbage containers should be left at curb only on the night preceding or the day of garbage pick-up.
